Welcome to Smarter Sparky. These Terms and Conditions (“Terms”) govern your use of the Smarter Sparky website, courses, tutoring services, educational content, and related services. By accessing or using this website or any services provided by Smarter Sparky, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use this website or services.

1. Educational Purpose Only

Smarter Sparky provides educational content intended to help individuals prepare for electrical licensing examinations and improve their understanding of electrical theory, code concepts, and related topics.

All content, tutoring, courses, videos, blog posts, downloadable materials, and other resources are provided for informational and educational purposes only.

Participation in any course or tutoring session does not:

Constitute formal apprenticeship training
Qualify an individual to perform electrical work
Grant any professional license or certification
Guarantee examination success
Replace required field experience, apprenticeship requirements, or state licensing requirements

Users are solely responsible for complying with all applicable laws, codes, regulations, licensing requirements, and safety standards in their jurisdiction.

2. No Professional, Legal, or Engineering Advice

Content provided by Smarter Sparky is not professional engineering advice, legal advice, code enforcement guidance, or official interpretation of any electrical code.

Electrical codes and regulations may vary by jurisdiction and may change over time. Users should always consult the currently adopted code books, applicable authorities having jurisdiction (AHJs), licensed professionals, and official state or local agencies when performing electrical work or preparing for licensing examinations.

3. Assumption of Risk

Electrical work involves inherent risks, including but not limited to serious injury, death, fire, arc flash, electrical shock, equipment damage, and property damage.

Users acknowledge and agree that:

Any practical application of information obtained through Smarter Sparky is done entirely at the user’s own risk
Smarter Sparky is not responsible for how users apply educational information
Users are responsible for obtaining proper supervision, licensing, permits, inspections, and training before performing electrical work

4. No Guarantee of Results

Smarter Sparky does not guarantee:

That any student will pass an examination
That any user will obtain or maintain a license
Employment opportunities or career outcomes
Specific scores or performance improvements
That course materials will match every jurisdiction’s exam content

Individual results depend on many factors outside the control of Smarter Sparky, including study habits, experience level, exam changes, and jurisdiction-specific requirements.

5. Payments and Refunds

By purchasing tutoring sessions, classes, or other services, you agree to provide accurate payment information and authorize payment for the services selected.

Unless otherwise stated at the time of purchase:

Payments are non-refundable once services have been delivered
Missed tutoring sessions may be forfeited without refund
Rescheduling requests should be made with reasonable notice
Smarter Sparky reserves the right to refuse service, cancel sessions, or issue refunds at its discretion

Test Prep Course Refund and Cancellation Policy

Students may cancel their enrollment before the first scheduled class session for a full refund.
If a student cancels after attending the first class session, they may still receive a full refund.
If a student cancels after the second, third, or fourth class session, a prorated refund may be issued based on the percentage of the course remaining.
No refunds will be issued after the fifth class session.
Smarter Sparky reserves the right to evaluate refund eligibility and calculate prorated refunds at its reasonable discretion.

6. Scheduling, Cancellations, and Attendance

Arriving on time for tutoring sessions or classes
Maintaining a reliable internet connection for online sessions
Providing accurate contact information
Ensuring appropriate equipment and software necessary to participate

Tutoring Cancellation and Rescheduling Policy

Students may request a refund or reschedule a tutoring session if the request is made more than eight (8) hours before the scheduled session time.
Cancellations made within eight (8) hours of the scheduled session are non-refundable.
Tutoring sessions may generally be rescheduled once. Additional rescheduling requests may be approved solely at the discretion of the instructor.
Missed sessions are non-refundable and any rescheduling of missed sessions is solely at the discretion of the instructor.
If a student does not attend the session or contact the instructor within the first five (5) minutes of the scheduled start time, the session may be considered abandoned and closed.

7. Intellectual Property

All original content on this website and within Smarter Sparky services, including videos, course materials, study guides, graphics, logos, text, blog posts, practice questions, downloads, branding, and instructional content created by Smarter Sparky, is the property of Smarter Sparky unless otherwise stated and is protected by applicable intellectual property laws.

Certain materials, references, trademarks, standards, or code excerpts may be the property of third parties, including but not limited to the National Electrical Code (NEC) and publications of the National Fire Protection Association (NFPA). Such materials remain the property of their respective owners and may be used for educational, commentary, reference, or informational purposes where applicable.

8. User Conduct

Use the website unlawfully
Attempt to gain unauthorized access to systems or accounts
Disrupt website functionality
Harass, threaten, or abuse others
Share malicious software or harmful content
Violate intellectual property rights
Misrepresent identity or credentials

9. Disclaimer of Warranties

All services and content are provided “as is” and “as available” without warranties of any kind, whether express or implied.

10. Limitation of Liability
